This Release and Waiver of Liability (the “Release”) executed on this ___ day of ______________, 20___, by or on behalf of________________________ (the “Volunteer”) in favor of Habitat for Humanity International, Inc., a nonprofit corporation, and Habitat for Humanity of Madison and Clark Counties, Inc, Kentucky nonprofit corporation, their directors, officers, employees, volunteers, sponsors, and agents, successors, and assigns (collectively “Habitat”).
The Volunteer desires to volunteer for Habitat and engage in activities including constructing and rehabilitating residential buildings and components for same, working in the Habitat offices or other facilities, and living in housing provided for volunteers of Habitat (the “Activities”). Volunteer understands that the Activities can be hazardous. In consideration for participating in the Activities, the Volunteer executes this Release:
Release and Waiver: Volunteer releases Habitat from all liability for any claims involving negligence of any party, including claims for personal injury, illness, death, or property damage, that may result from or relate to the Volunteer’s Activities, and injuries resulting from Volunteer’s own conduct or the conduct of Habitat, its agents, or other volunteers. This release includes a release of liability for all claims related to COVID-19 and illnesses or injury related to the virus that causes it. Volunteer also understands that Habitat does not assume responsibility for or obligation to provide financial or other assistance, including but not limited to medical, health, or disability insurance. In the event that Habitat, in its sole discretion, does maintain insurance that may provide coverage for otherwise released claims, this release shall not operate for the benefit of any such insurance carrier. Each Volunteer is expected and encouraged to maintain his or her own insurance coverage.
Photographic Release. Volunteer/Parent/Guardian does hereby grant and convey unto Habitat all right, title, and interest in any and all photographic images and video or audio recordings made by Habitat during the Volunteer’s Activities with Habitat, including, but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings.
Other. Volunteer expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the Commonwealth of Kentucky, and that this Release shall be governed by and interpreted in accordance with the laws of the Commonwealth of Kentucky. Volunteer agrees that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity or of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable.
